Monitoring izveštaj ANEM-a za jul 2023. godine o slobodi izražavanja, starim i novim propisima i analizom SLAPP tužbi

Monitoring medijske scene izrađuje se s ciljem kontinuiranog praćenja događaja i procesa koji utiču na stanje medijskih sloboda u Republici Srbiji. Autori monitoringa bave se: slobodom izražavanja; praćenjem implementacije postojećih propisa; usvajanjem novih propisa, ali i izmenama i dopunama aktuelnih, kako iz oblasti medija, tako i iz drugih oblasti koje na direktan ili indirektan način utiču na slobodu medija; kao i analizom SLAPP tužbi (strateških tužbi protiv učešća javnosti) usmerenih prema novinarima i medijima.

Sloboda izražavanja

Za jul mesec analiziran je izveštaj „Bezbednost novinara u digitalnom okruženju”, koji su objavile Nezavisno udruženje novinara Srbije (NUNS) i Balkanska istraživačka mreža BIRN Srbija (BIRN), i iz koga su izdvojeni najbitniji zaključci.

Udruženje novinara Srbije (UNS) objavilo je podatak da je zabeležilo 67 slučajeva ugrožavanja bezbednosti novinara tokom prve polovine 2023. godine, a najučestaliji oblik ugrožavanja bezbednosti su pritisci, pretnje, kao i fizički napadi, slučajevi onemogućavanja rada, zastrašivanja, napadi na imovinu novinara i ugrožavanje njihove privatnosti.

Detaljnije je analiziran slučaj Olivere Vladković, vlasnice OK radija, i Svetlane Ivanov, zaposlene u OK radiju, zatim slučaj Dinka Gruhonjića, programskog direktora Nezavisnog društva novinara Vojvodine (NDNV), glavnog i odgovornog urednik portala Vojvođanski istraživačko-analitički centar (VOICE) i zamenika glavne i odgovorne urednice portala Autonomija, slučaj objavljivanja spota ,,Stop stranoj propagandi” kojim se targetiraju novinari N1, Nova S i Nova, kao i slučaj Srđana Nonića, glavnog i odgovornog urednika portala Niška inicijativa i građanskog aktiviste. 

Monitoring procesa usvajanja novih zakona 

I dalje se odlaže usvajanje izmena ključnih medijskih zakona, na koje se država obavezala. Nacrt novog Zakona o elektronskim medijma (ZEM), kao i Nacrt novog Zakona o javnom informisanju i medijima (ZJIM) – završeni su u maju, imajući u vidu da je aprilski rok bio probijen. Javne rasprave o navedenim nacrtima još uvek nisu počele, niti je predstavnicima novinarskih udruženja i asocijacija medija poznato kada će početi.

Implementacija postojećih propisa

U vezi sa projektnim sufinansiranjem, mesec jul je obeležilo kašnjenje Ministarstva informisanja i telekomunikacija, tako da su rezultati konkursa za sufinansiranje proizvodnje medijskih sadržaja od interesa za javnost objavljeni tek 11. 8. 2023. godine.

Komisije za ocenjivanje projekata u opštinama nastavljaju sa ustaljenim principom dodeljivanja najvećih iznosa medijima bliskim vladajućoj stranci. U izveštaju su detaljno navedeni predlozi komisije u opštini Sombor, gde je sredstva dobilo 18 od 40 medija koji su konkurisali, a najviše - ,,Udruženje građana Ja volim Sombor, Sombor’’ za projekat koji će realizovati medij ,,025.rs’’, ,,NS vid media doo Novi Sad’’ za projekat koji će realizovati ,,Radio Sombor’’ i ,,Televizija Sombor doo Sombor’’ sa projektom koji će se realizovati na ,,Tv Sombor.” Sredstva su dobili i ,,Preduzeće za radio i televizijske aktivnosti STV Ka-54 doo Sombor’’, ,,Milan Šveljo pr proizvodnja kinematografskih dela audio vizuelnih proizvoda i televizijskog programa Video kreativa tim Sombor’’, zatim ,,Vtv doo Subotica’’, ,,Društvo sa ograničenom odgovornošću informativno - propagandni centar Kula, Kula’’, ,,Društvo sa ograničenom odgovornošću ApaOne Novi Sad’’, kao i drugi mediji navedeni u izveštaju.

Kada je u pitanju Inđija, 20 medijskih projekata podržano je iznosom od 25,8 miliona dinara iz budžeta opštine: ,,Sremska televizija doo Šid’’ i ,,Radio televizija Inđija doo, Inđija’’ dobile su po 6 miliona dinara, odnosno skoro polovinu ukupno raspoloživog iznosa. Sredstva su dobili i ,,Inđijska panorama’’, ,,Društvo za trgovinu promet i usluge Infocyber doo Inđija’’, ,,Gradske info doo Novi Sad’’, kao i ,,Saveta Kovačević pr audio i video produkcija centralna produkcija Veliki Radinci’’. Produkciji ,,QWP media društvo sa ograničenom odgovornošću Beograd – Novi Beograd’’ pripalo je 2 miliona dinara, a ,,Novinsko – izdavačko privredno društvo Sremske novine doo Sremska Mitrovica’’ je 1,2 miliona dinara.

Kada je reč o borskim medijima, od predviđenih 8 miliona dinara za sufinansiranje u 2023. godini, Komisija za ocenu medijskih projekata je raspodelila 7,6 miliona dinara, a najveći iznos dodeljen je produkciji ,,Smilja Đorđević preduzetnik produkcija audio-video zapisa i konsultantske usluge S media team Beograd-Zemun’’ za projekat koji će realizovati ,,TV Studio B’’ – 1,5 miliona dinara. Pažnja je usmerena na zanimljiv slučaj ,,Društvo sa ograničenom odgovornošću Digital 030 Bor’’, kome je za projekat koji će realizovati ,,Internet portal www.digital030.rs’’ pripao iznos od 1,48 miliona dinara, iako je pomenuti portal u registar medija upisan 2021. godine, a do danas na svom sajtu ima svega devet informacija. Sredstva su dodeljena i „Nada Gudurić PR agencija za informativnu delatnost i marketing Npress Bor”, zatim ,,Medijski centar radio kometa – Klik d.o.o. Bor”, ,,Društvo sa ograničenom odgovornošću za izdavanje novina MM Boned, Bor’’, njihovom štampanom glasilu „Nedeljnik Timočke Krajine Timočke’’, kao i firmi ,,Hype showtime doo Zaječar’’.

SERBIA'S MEDIA SCENE IN JULY 2023

Monitoring of the media scene is carried out with the aim of continuous monitoring of events and processes that affect the state of media freedom in the Republic of Serbia. The authors of the monitoring deal with: freedom of expression; monitoring the implementation of existing regulations; by adopting new regulations, but also by amending and supplementing the current ones, both from the field of media, and from other areas that directly or indirectly affect the freedom of the media; as well as by analyzing SLAPP lawsuits (strategic lawsuits against public participation) directed against journalists and media.

Freedom of speech

For the month of July, the report "Safety of journalists in the digital environment", published by the Independent Journalists Association of Serbia (NUNS) and the Balkan Research Network BIRN Serbia (BIRN), was analyzed, and from which the most important conclusions were extracted.

The Association of Journalists of Serbia (UNS) announced that it recorded 67 cases of endangering the safety of journalists during the first half of 2023, and the most frequent forms of endangering safety are pressure, threats, as well as physical attacks, cases of preventing work, intimidation, attacks on journalists' property and compromising their privacy.

The case of Olivera Vladković, the owner of OK Radio, and Svetlana Ivanov, an employee of OK Radio, was analyzed in more detail, then the case of Dinko Gruhonjić, program director of the Independent Journalists' Association of Vojvodina (NDNV), editor-in-chief of the Vojvodina Research and Analytical Center (VOICE) portal and deputy editor-in-chief of the Autonomija portal, the case of the publication of the video "Stop Foreign Propaganda" targeting journalists N1, Nova S and Nova, as well as the case of Srđan Nonić, the editor-in-chief of the Niš initiative portal and a civil activist.

Monitoring of the process of adoption of new laws

The adoption of amendments to key media laws, which the state has committed to, is still being delayed. The draft of the new Law on Electronic Media (ZEM), as well as the Draft of the new Law on Public Information and Media (ZJIM) - were completed in May, bearing in mind that the April deadline was missed. Public discussions on the mentioned drafts have not started yet, nor do the representatives of journalist associations and media associations know when they will start.

Implementation of existing regulations

In connection with project co-financing, the month of July was marked by the delay of the Ministry of Information and Telecommunications, so that the results of the competition for co-financing the production of media content of interest to the public were announced only on August 11, 2023.

Commissions for evaluating projects in municipalities continue with the established principle of awarding the largest amounts to media close to the ruling party. The report details the proposals of the commission in the municipality of Sombor, where 18 of the 40 media that applied received funding, and the most - "Citizens' association I love Sombor" for the project that will be implemented by the media "025.rs"; "NS vid media doo Novi Sad" for the project that will be realized by "Radio Sombor" and "Televizija Sombor doo Sombor" with the project that will be realized on "Tv Sombor." Funds were also received by "Company for radio and television activities STV Ka-54 doo Sombor", "Milan Šveljo PR production of cinematographic works of audio visual products and television program Video creative team Sombor", then "VTV LLC Subotica", "Propaganda Center Kula LLC, Kula", "ApaOne Novi Sad LLC", as well as other media mentioned in the report.

When it comes to Inđija, 20 media projects were supported in the amount of 25.8 million dinars from the municipal budget: "Sremska televizija LLC Šid" and "Radio televizija Inđija LLC" each received 6 million dinars, i.e. almost half of the total amount available. Funds were also received by "Inđijska panorama", "Company for trade, traffic and services Infocyber LLC Inđija", "Gradske info LLC Novi Sad", as well as "Saveta Kovačević PR audio and video production central production Veliki Radinci". The production of "QWP media LLC Belgrade - Novi Beograd" received 2 million dinars, and "Newspaper publishing company Sremske novine LLC Sremska Mitrovica" received 1.2 million dinars.

When it comes to the media in Bor, out of the 8 million dinars foreseen for co-financing in 2023, the Commission for the Evaluation of Media Projects distributed 7.6 million dinars, and the largest amount was allocated to the "Smilja Đorđević, an entrepreneur in the production of audio-video records and consultancy services of S media team Belgrade-Zemun'' for the project that will be realized by TV Studio B - 1.5 million dinars. Attention is focused on the interesting case of the "Digital 030 Bor LLC", which received an amount of 1.48 million dinars for the project to be implemented by the "Internet portal www.digital030.rs", although the said portal was registered in 2021 but to date there are only nine pieces of information on its website. Funds were also allocated to "Nada Gudurić PR agency for information activities and marketing Npress Bor", then "Media center radio comet - Klik LLC Bor", "MM Boned LLC for the publication of newspapers, Bor", their printed newsletter "Nedeljnik Timočka Krajina Timočka", as well as the company "Hype showtime LLC Zaječar".
